Often, questions arise in the inheritance law about the testament or the nomination of the beneficiary of the marriage partner.
In addition, the inheritance law has a proximity with regard to contents of the law on protection of adults in terms of patient decree and advance care directive. These expire with the demise of the concerned person. It is however possible to provide in the advance care directive that parts of it and the corresponding power of procuration shall remain valid beyond the demise. Thereafter the law on protection of adults is no longer applicable, but the corresponding dispositions in the Code of Obligations respectively in the inheritance law. The power of the adult protection authority pertaining to the authorised person do not apply and the heirs as well as the authorities of inheritance will be competent.
